Classic defense arguments rely on expert claims that "the outcome would not have been any different" with earlier surgery, and often cite for support old and now-disproven science that "the damage is already done" at the time of injury. The STASCIS study and Badhiwala article both definitively prove that defense of delay in diagnosis and surgical treatment of patients with acute traumatic SCI can no longer reasonably rely upon additional schools of thought, established protocols, or even physician judgment supporting delayed surgery as within the standard of care.
